In consideration of “Client”, the purchaser of the “Single Session Tune-Up”, retaining “Coach”, Genevieve Joy Miller to perform healing and coaching services via the Single Session Tune-Up (“Program”) it is agreed as follows:
TERMS AND AGREEMENTS
In consideration of the mutual covenants set forth in this agreement, Client and Coach hereby agree as follows:
1. Scope of Program
Client hereby retains Coach to provide one 2 hour virtual coaching and healing session delivered via Zoom. Session Pre-Work Worksheet created by Coach and delivered to Client via email upon purchase.
2. Delivery of Work
A date for the coaching and healing session will be chosen collaboratively between Coach and Client and adhered to upon signing the agreement.
3. Methodology
Coach will employ a range of methodologies to suit Client’s personal values and style. Client agrees to be open-minded and partake in the methods Coach proposes. Client understands that Coach has made no guarantees as to the outcome of the coaching sessions as that Coach is not a psychotherapist or physician.
4. Payment
In consideration of services provided by Coach to Client, Client agrees to pay Coach a fee of $500, the full amount of which is due before the session is scheduled. Client agrees to render payment via Credit Card or Bank Transfer.
Client understands he/she is responsible for the full payment and agrees to pay the sum requested in full electronically via a designated third party payment processor of Coach’s choosing. Absent an agreement regarding a payment plan with Coach, Client must complete payment in full before becoming entitled to any products or services included within Program.
5. Refund Policy
Should Client change their mind about working with Coach and participating in Program after submitting payment in full, Client must notify Coach in writing via email or Voxer of their intent to terminate services at least 10 business days before Client’s first scheduled session. Coach will refund the full amount of Client’s purchase to Client via Client’s original method of payment within 10 business days of receipt of Client’s written intent to terminate services.
There are absolutely no refunds on sessions that have been scheduled or services that have been rendered.
By signing this document, Client acknowledges they have reviewed this Scope of Program, completed any and all appropriate additional research, and asked any and all necessary questions of Coach in order to feel appropriately educated of the Program and services being offered. Client understands he/she will not be entitled to a refund once completing this purchase for any reason, other than discussed above.
6. Cancellation and Rescheduling Policy
Coach and Client will each make every effort to attend the session at its scheduled start time. Should Client need to reschedule the session, Client will inform Coach via email or Voxer at least 24 hours prior to the scheduled start of the session. If Cancellation is made within 24 hours of the scheduled session, Coach will take reasonable measures to reschedule the session for the Client.
Should Coach need to reschedule a session, Coach will do everything possible to provide Client with as much notice as possible, and to reschedule at a mutually agreeable time.
If Client is late for his/her scheduled session, it will shorten his/her session time and Coach is not obligated to make up that time.
If Client is a “no show” for a session and does not provide any advance notice that he/she will not be able to attend the session, Client understands Coach is entitled to cancel the session without rescheduling, and may cause Client to forfeit the session, and Client will still be obligated to pay the entire amount listed in this agreement.
7. Confidentiality
Coach has the right to use case studies of Client’s situations and results or Client testimonials in future work but without making reference to Client’s full identity if so requested by Client. Client will always be contacted for approval prior to any case study or testimonial being published.
8. Good Faith
Each party represents and warrants to the other that such party has acted in good faith, and agrees to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement.
9. Agreement Between Coach and Client
Client agrees to not withhold any information that could affect Client’s outcome of the coaching process. Client agrees to complete all assigned tasks to their fullest ability and to be open, present and prepared for all sessions. Client is responsible for their own success and implementation of objectives.
10. Intellectual Property Rights
Client agrees not to share, reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Program, including Program materials and intellectual property, use of the Program or access to the Program materials.
11. Medical Disclaimer
Client is aware that Coach does not solve medical issues nor treat disease and is therefore not a replacement for client’s doctor, therapist or physician. If Client is presently under any form of psychiatric care, psychological therapy, specialized medical supervision or under the influence of any form of medication, Client is to inform Coach prior to the start of Coaching services.
12. Limitation of Liability
By using Genevieve Joy Quantum Healing services, Client accepts any and all risks, foreseeable or non-foreseeable, arising from such transactions. All claims against Genevieve Joy Quantum Healing must be lodged within the State of California within 100 days of the date of the first claim or otherwise be forfeited forever.
Client agrees that Coach will not be held liable for any damages of any kind resulting or arising from including but not limited to direct, indirect, incidental, special, negligent, consequential or exemplary damages happening from the use or misuse of the Service. Client agrees that use of this service is at Client’s own risk.
Client agrees that he/she is voluntarily choosing to enroll in Program and is solely responsible for any outcomes or results. While Coach believes in her services and is able to help many people to achieve their desired results, Client acknowledges and agrees that Coach is not liable to client should Client sustain any injuries, incur harm, or encounter any negative ramifications. Client agrees that he/she is fully responsible for his/her health and wellbeing including participation in program and any results therein.
